TERMS AND CONDITIONS

This policy, known as the “Policy,” pertains to the practices of treehaus regarding the collection, use, and protection of personal information obtained from individuals through the website, https://atreegrows.com (“Website”) and includes information related to the terms and conditions associated with the purchases of “Services” from treehaus.
Terms Acceptance
The terms and conditions (T&C) below relate to the Services provided by treehaus. These T&C apply to individuals who have activated Services or become members of treehaus. treehaus reserves the right to update these T&C without prior notice to clients or members. The updated version will be reflected by a new "Effective Date." Clients and members are encouraged to periodically review these T&C to stay informed about any changes in privacy practices and understand and abide by these terms as they govern the use of treehaus Services.
Collected Personal Information
Any purchase of treehaus cowork passes (drop in/day pass/5 day and memberships) results in the collection of personal data including names, email addresses and telephone numbers. This information will not be shared with external parties. Collected email addresses may be used to add individuals to treehaus’s mailing list. However, all parties have the option to unsubscribe from these mailing lists at their discretion. When the user provides payment information, such as credit card details, this information is securely managed by the financial Services platform, Square.
Services Provided
treehaus offers various Services that include access to desks, internet, office equipment, a phone booth, an outdoor deck, pantry, restroom facilities, space rentals, classes and possibly other related Services known as “Services.” The use of these Services is subject to the T&C.
Cancellation Policy
The purchase of a Day Pass, Drop in, 5 Day Pass or Monthly Subscription, if unused, can be refunded within 30 days of receipt of purchase.
Membership: Within the Acuity Scheduling Program (Squarespace) when you log in, you can cancel your recurring subscription at any time for the ensuing months. Memberships recur each month and are nonrefundable if used. However, a partial refund will be evaluated on a case by case basis if you wish to cancel.
treehaus reserves the right to close for an extended period of time due to unsafe weather conditions or other unforeseen circumstances. We will cease any billing until conditions are safe for business to return to normal.
Use of Services
You agree to the following while engaging with the Services at treehaus. Users must adhere to any applicable code of conduct or guidelines, which include the house rules. The following are a list of prohibited activities:
Users are not allowed to engage in hostile activities that include defaming, abusing, harassing, stalking, threatening, or violating the legal rights of others. This includes rights of privacy and publicity.
Other forbidden behavior includes sexual harassment, verbal abuse, physical violence, or discrimination based on race, gender, or any other characteristic. A violation of any of these policies may terminate in suspension or expulsion from treehaus.
Any illegal or prohibited use of the Services is not allowed. Users are prohibited from doing harm to systems or using the Services in a way that could damage, disable, and overburden treehaus’s network.
Users should not interfere or restrict the use and enjoyment of the Services by other parties. This is to ensure a positive and unhindered experience for all users.
Unauthorized access to any Services, accounts, computer systems or treehaus networks is strictly forbidden. This includes activities like hacking or attempting to mine passwords. Users are only allowed to access materials and information that are intentionally made available through the Services. Unauthorized or illicit methods of obtaining materials or information are not permitted.
Users should not download files that they know or reasonably should know cannot be legally reproduced, displayed, performed, or distributed in the manner in which they intend to use them.
Users are not allowed to publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, obscene, indecent, or unlawful topic, name, material, or information on or through treehaus’s network.
Users are prohibited from uploading files that may contain viruses, malware, or other harmful software that can damage other computers or property.
Users are not allowed to harbor or collect information about others, (email addresses included), without proper authorization or consent.
Users are not allowed to create a false identity with the intent to deceive.
Users should not upload or make available any files that contain images, photographs, or software protected by intellectual property laws (e.g., copyright or trademark laws) unless they have the necessary rights or consents to do so.
Users are prohibited from disclosing the treehaus WiFi password to any individuals outside of the coworking environment. This password is exclusive to those using treehaus coworking Services.
Users are prohibited from using materials or information from the Services in a way that infringes on the copyright, trademark, patent, trade secret, or other proprietary rights of any party.
Compliance with Laws
Users must comply with all applicable laws and regulations
Signage
treehaus management is solely allowed to exhibit signage.
Lost, Stolen, or Damaged Items
treehaus is not responsible for any items that are lost, stolen, or damaged while renting their premises. This means that users are expected to take precautions and responsibility for their belongings.
Insurance
treehaus carries Liability and Business Personal Property insurance, which covers their own liability and property.
Severability
In case one or more parts of the terms and conditions are challenged or invalidated, the remaining provisions can continue to be upheld to the maximum extent possible under the law, even if some specific terms are deemed unenforceable.
Noise Control
All treehaus users are expected to be mindful of the noise they generate and keep it at a level that doesn't disturb others. This includes avoiding loud conversations, phone calls, or any activities that could be disruptive. It’s important to respect fellow users by ensuring that their work is not disrupted by excessive noise. treehaus aims to foster a productive and conducive working atmosphere where all members can focus on their tasks effectively.
Guests
A guest is defined as a person or persons that are visiting a treehaus user for a period not to exceed one day pass. They are to follow all the terms and conditions set forth in this agreement.
Drug and Smoke-Free Facility
treehaus does not permit smoking or use of any smoking products, including traditional tobacco and cannabis inside our facility or on our deck or backyard. Other prohibited practices include candle/incense burning and outlet fragrance warmers. We are also a drug-free facility and do not permit alcohol during cowork hours. The possession, use, sale, or distribution of illegal drugs or controlled substances is explicitly prohibited within all the indoor and outdoor premises of treehaus. Individuals found to be in violation of this may result in the revocation of your access to treehaus.
Audio and Video Recording
treehaus users are forbidden from initiating any kind of unrequested or unauthorized audio or video recording without the explicit consent of all parties involved. Any unauthorized or unrequested recording and/or distribution of audio or video content can lead to legal consequences. treehaus management will address this infraction immediately to protect the privacy and security of all. The individual(s) who violate this prohibition may face legal action.
Termination Notice
treehaus reserves the right to terminate any service at any time. treehaus further reserves the right to cancel your participation in the use of any Services, immediately and without notice, if you fail to follow the terms of this user agreement.
Information Disclosure and Content Control
Users should be cautious about sharing sensitive or confidential information on the treehaus network since it may be disclosed under certain circumstances. treehaus retains the right to disclose any information about you, as well as your participation and use of our Services, as we see fit. The circumstances under which such disclosure may occur include when it's necessary to comply with applicable laws, regulations, legal processes, or government requests. treehaus also reserves the right to control the content posted on our platform. This includes the authority to edit, refuse to post, or remove any information or materials, either in whole or in part, at our sole discretion. This control is exercised to ensure that the content aligns with treehaus’s guidelines and policies.
Confidentiality
Confidential Information, as defined in this agreement, encompasses all nonpublic, confidential, or proprietary information disclosed by treehaus, participants or users of the Services, employees, affiliates, or agents. It includes various categories of information, such as business details, trade secrets, technology, financial information, and more. Users are obligated to maintain Confidential Information in strict confidence. They should not disclose it to third parties or use it in a manner that could be detrimental to treehaus, participants, or users of the Services. All Confidential Information remains the exclusive property of treehaus or the respective disclosing party. Users are not granted any rights to this information or the associated intellectual property rights. Users acknowledge that their participation in or use of the Services is voluntary and at their own discretion. They also recognize that treehaus holds no liability regarding their access, participation, use of the Services, or any potential loss of information resulting from their participation.
Disclaimer of Warranties
treehaus provides its Services "as is" and with all faults. Our Services are offered in their current condition, and treehaus makes no guarantees or warranties about their quality or performance. There is also no warranty, duty, or condition related to title, quiet enjoyment, quiet possession, correspondence to description, or non-infringement. The user assumes the entire risk regarding the quality of the Services and any issues or consequences that may arise from participating in or using the Services. treehaus is not liable for various types of damages, including direct, special, incidental, indirect, punitive, and consequential damages.These damages could include losses such as profits, confidential information, business interruption, personal injury, loss of privacy, and other pecuniary or non-pecuniary losses. This limitation of liability applies regardless of the legal basis for a claim, such as fault, tort, strict liability, breach of contract, or breach of warranty by treehaus. Some states or jurisdictions may not allow the exclusion or limitation of liability for certain types of damages, so the above limitation may not apply in those cases. treehaus provides its Services without warranties and limitations its liability for various types of damages. Users are encouraged to review and understand these terms before participating in or using the Services.
Limitation of Liability and Remedies
Regardless of the reason for incurring damages, treehaus’s liability and the exclusive remedy for any such damages are limited. The maximum liability, even for all types of damages, is capped at ten dollars (USD 10.00) based on reasonable reliance. The limitations, exclusions, and disclaimers apply to the maximum extent permitted by applicable law, even if a remedy fails its essential purpose.
Users release and agree to indemnify, defend, and save treehaus and its subsidiaries, affiliates, officers, agents, shareholders, representatives, and others mentioned from and against various claims, liabilities, losses, damages, costs, expenses, and legal actions. This includes claims arising from negligent actions, errors, omissions, willful misconduct, and fraud related to participation in or use of the Services.
If a user brings a claim or lawsuit in violation of this agreement, they may be held liable for the attorneys' fees and costs incurred by treehaus or its respective officers and agents in defending against such claims or lawsuits.
It is important for users to understand these provisions and their potential legal implications.
House Rules
We welcome you to work with us at treehaus. While in the space, bins and shelves are labeled for your accessibility. The following are some house rules we want you to be aware of:
Reservations: If you need to reserve the phone booth, please request the scheduled time when you are booking your pass. We must be courteous of others’ needs to use the phone booth at reserved times.
Cleanup: We keep a tidy environment at treehaus. Each user is responsible for their own clean workstation. Please always remember to clean up before you leave. We recycle paper and plastic. Place your dishware in the sink and throw out any garbage you might have.
Etiquette: We aim to have a harmonious environment at treehaus. We always want you to be mindful of noise level, treating the space like it’s your home, not taking items that do not belong to you and to always treat one another respectfully.
